SUBJECT: AMC 10.48 Overnight Sleeping in Vehicles Permit
PURPOSE: To establish a permit process for AMC 10.48
STATEMENT OF POLICY: This sets forth the City's policy on permitting overnight sleeping in vehicles pursuant to
AMC 10.48 Overnight Sleeping in Vehicles for Religious Institutions. The policy outlines the permitting process and the requirements to be met by the Religious Institutions in order allow for overnight sleeping in vehicles on their parking lots. These requirements include:
• Number of vehicles:
o No more than three vehicles, defined as a car, camper, travel trailer, recreational vehicle, or similar conveyance.
• The Religious Institution must:
o Own or lease real property on which a structure and an associated parking lot are located;
o Provide sanitary facilities including, but not limited to, toilet, hand washing, and trash disposal facilities;
o Not allow the overnight users’ personal items to be visible from any public street; and
o Not require payment of any fee, rent, or other monetary charge for overnight sleeping in a vehicle.
The Chief of Police will be involved in reviewing the permit applications and in evaluating permit compliance. The City Manager or City Manager’s designee will be responsible for approving the permits. The Chief of Police will also assist the City Manager or designee in determining whether a permit should be revoked in the event of a threat to public health, safety, or welfare.
