Title: Continuance of Public Hearing for Planning Action 2001-103, Kaufmann Crossing zone change and comprehensive plan map amendment for property at the old Croman Mill site.

Synopsis: An appeal was filed by the applicant regarding the denial of the above referenced planning action by the Planning Commission. The applicant's attorney, John Hassen has requested that the hearing, scheduled for the January 15, 2002 City Council meeting, be continued to the February 19, 2002 meeting. The continuance will allow the applicant an opportunity to meet with Staff in an attempt to resolve issues connected to the appeal.
Recommendation: Staff recommends that the public hearing be opened and announced that the hearing has been continued to the February 19, 2002 council meeting at 7pm at 1175 East Main Street.
Fiscal Impact: None.
Background: On November 13, 2001, the Planning Commission held a public heating on the request, at which time testimony was heard and exhibits were presented. However, at the end of the public hearing, the meeting had to be concluded due to it being 1 lpm. The meeting was resumed on December 11,2001 at which time the Planning Commission heard limited rebuttal testimony and deliberated towards a unanimous denial. The applicant filed a timely notice of appeal and the action was noticed for a public hearing in front of the City Council on January 15, 2002. The applicant is now requesting a continuance to the February 19, 2002 meeting.

Dear Mr. Scoles:

As you know, our office represents Galpin, L.L.C., in connection with Planning Action 2001-103.

The hearing in connection with the above referenced appeal has been set for January 15, 2002. Request is hereby made that the appeal hearing be continued to the Council's meeting on February 19, 2002, to give us time to meet with Planning staff to attempt to resolve issues in connection with the appeal.

On behalf of the applicant, Galpin LLC, the 120 day period is hereby extended by 35 days, the period of time for which the extension is requested. Please let me know if you require anything further in order to extend the hearing.
