Synopsis: Site Review approval to construct the new fire station at 455 Siskiyou Blvd. was granted by the Ashland Planning Commission on May 8, 2001. A condition of approval for the project was to obtain a shared driveway agreement with the owners of the adjacent property at 505 Siskiyou Blvd., George R. Walker and Patricia Walker. Mr. & Mrs. Walker have been very cooperative in our efforts to obtain this agreement. The Mutual Access Easement Agreement requires City Council approval.
Recommendation: Staff recommends that Council authorize the mayor to sign the Mutual Access Easement Agreement.
Fiscal Impact: The cost of installing the new shared access driveway will be included in the new fire station construction project.
Background: The Siskiyou Blvd. redesign project provides for improvements in the management of traffic flows through this important transportation corridor within the city. The engineering and design process included a review of existing access points, and the present traffic management system in conjunction with the new fire station reconstruction project. Consolidation of the existing driveways for the fire station and the Walker Property will enhance vehicle and pedestrian safety at the new fire station site. This initiative has also provided both property owners to collaborate on the beautification of the current streetscape and property landscaping.

MUTUAL ACCESS AGREEMENT

AGREEMENT made this day of , 2001, between the above-named Grantor and Grantee.

Recital: Grantor desires to grant to Grantees a perpetual, nonexclusive easement across property described on the attached Exhibit "A" (further referred to in this agreement as "Grantor's property") to provide ingress and egress to property described on the attached Exhibit "B" (further referred to in this agreement as "Grantees' property"), and Grantees desire to grant to Grantor a perpetual, nonexclusive easement across Grantees' property to provide ingress and egress to Grantor's property.

Grantor and Grantees agree:

1. Grantor grants to Grantees a perpetual, nonexclusive easement across Grantor's property in the area described on the attached Exhibit "C" (further referred to in this agreement as the "easement area") for the purpose for providing ingress and egress for Grantees and Grantees' invitees, guests, agents and independent contractors. Attached as Exhibit "D" is a map showing the easement area.

2. Grantees grant to Grantor a perpetual, nonexclusive easement across Grantees' property in the easement area described on the attached Exhibit "C" for the purpose for providing ingress and egress for Grantor and Grantor's invitees, guests, agents and independent contractors.

3. Grantor shall bear the responsibility to bring the easement area described in Exhibit "C" to city standards and maintain it to those standards.

4. The parties understand and agree for themselves, their successors and assigns not to cause or allow the construction or maintenance of any building or other structure in nor upon the easement area. Grantor and Grantees understand and agree that the other party may cause the summary removal of any such building or structure so placed and that Grantor and Grantees shall make no claim for and shall hold the other harmless from any claim by a third person for damage to or destruction of the property so removed.

5. This easement is appurtenant to the real property owned by Grantor described in Exhibit "A" and to the real property owned by Grantees described in Exhibit "B."

6. This Agreement is granted subject to all prior encumbrances of record.

7. This easement shall be perpetual, shall run with the land and be binding upon the parties, their heirs, successors and assigns.
