BEFORE THE CITY OF ASHLAND LOCAL CONTRACT REVIEW BOARD

A RESOLUTION DETERMINING CONTRACT WITH DAY WIRELESS SYSTEMS IS A SOLE-SOURCE CONTRACT AND EXEMPTING DAY WIRELESS SYSTEMS CONTRACT FROM FORMAL COMPETITIVE SOLICITATION REQUIREMENTS

LCRB RESOLUTION


Recitals:

A. The City Council's Goal No. 16 for the 2004-2005 fiscal year directs staff to resolve radio communications coverage deficiencies for fire department emergency communications.

B. The Ashland Fire Department has obtained a Department of Homeland Defense Grant in the amount of $190,380 to significantly offset the cost of installation of a radio repeater station to achieve this goal.

C. A basic two-way RF radio wave signal strength study was completed in November 2004 identifying a satisfactory site, owned by the City on Eagle Mill Road, for a radio repeater station to resolve emergency communications coverage deficiencies for Ashland Fire and Rescue.

D. A construction permit has been applied for through the Jackson County Building Department.

E. The city has determined that no competitive market exists. Specialized contracting for this large-scale communication system is needed. The city does not choose the service and maintenance provider of Motorola equipment; this equipment must be serviced by an official Motorola agent and/or service provider for Motorola to honor equipment warranties. Day Wireless is the exclusive authorized agent for Motorola in the Rogue Valley.

THE BOARD RESOLVES AS FOLLOWS:

SECTION 1. Pursuant to Ordinance No. 2917, adopted on March 1, 2005, specifically, Section 2.50.070.E., the City Council in its capacity of the Local Contract Review Board must approve sole source contracts that exceed $75,000.

SECTION 2. Based on the attached findings, the Board finds it in the best public interest and welfare to exempt the contract for resolving radio communications coverage deficiencies for fire department emergency communications from the bidding and solicitation requirements and authorize sole source execution of a contract for such services with Day Wireless Systems.

SECTION 3. This resolution takes effect upon signing by the Mayor.
