| Synopsis: |
This ordinance corrects the referring Chapter of
the Oregon Revised Statutes with regard to the election of candidates for
offices in the City of Ashland.
In addition, this ordinance clarifies the filing period of candidates
for City offices referring to Oregon Revised Statutes and is now the same
as stated in the Ashland City Charter.
Filing period for City Offices for the November 5, 2002 General Election
will open June 6, 2002 and will close at 5:00 p.m. on August 16, 2002. All
filings for City offices are conducted through the Office of the City
Recorder. |

| Background: |
Filing period for the General Election of November
5, 2002 for City offices is determined by the dates set by the State of Oregon.
ORS 221.280 provides the procedure for nomination of candidates for City
offices, if a city does not hold a nominating election for municipal
offices.
Article VII, Section 2, of the Ashland City Charter allows for a
filing deadline, which is 12 days before the date that the City Recorder
must file the same with the County Clerk. Previous code section did not match
what was stated in the Ashland City Charter. |

ORDINANCE NO. _______
AN ORDINANCE AMENDING SECTIONS 2.40.010 AND
2.40.020 OF THE ASHLAND MUNICIPAL CODE TO COMPLY
WITH THE CHARTER AND STATE LAW REGARDING FILING
OF NOMINATION PETITIONS FOR ELECTED OFFICIALS
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
Annotated to show deletions and additions to the code sections being modified.
Deletions are lined through and additions are
underlined.
SECTION 1. Section 2.40.010 of the Ashland Municipal Code is amended
to read:
Section 2.40.010. State Statutes Adopted. That portion of Chapter
256 249 of the Oregon Revised Statutes, which
applies to invorporated cities within the State which have a population of
two thousand (2,000) or more, with regard to the election of candidates
for offices in the City by means of placing the names of the candidates upon
the ballot of the general election be, and the same hereby is;
adopted by reference.
SECTION 2. Section 2.40.020 of the Ashland Municipal Code is amended
to read:
Section 2.40.020. Nominating Petitions--Time Limit. All nominating petitions
~ of candidates for City offices shall be filed with the office of the City
Recorder at least eighty-eight (88) days prior to the date of the
general election not sooner than the date specified in ORS 221.180,
and not later than the date provided in Article VII, Section 2, of the Ashland
City Charter, which is 12 days before the date the Recorder must file the
same with the County Clerk.
