| Synopsis: |
Mr. Bruce Davis is requesting sewer service on behalf
of Siskiyou Village, a mobile home park which is located outside the City
limits, but within the City's Urban Growth Boundary. Siskiyou Village is
located at the corner of Siskiyou and Crowson at 2799 Siskiyou Boulevard,
39 1E 14D TL700. Siskiyou Village supports 42 mobile home/RV spaces, 7 RV
pull-though spaces, and one fixed studio apartment. All of the units within
the mobile home park are connected to one of two failing septic systems.
Siskiyou Village is on a 10 acre parcel of property just outside City limits,
but within the City's Urban Growth Boundary. The property is within the Tolman
Creek drainage basin, which drains to Bear Creek. |
| Recommendation: |
It is recommended that the Council approve the sewer
connection for Siskiyou Village at 2799 Siskiyou Boulevard, and direct staff
to obtain all necessary agreements prior to final connection. This request
meets the City's requirements for connection to the sewer system, and due
to the potential negative environmental impacts of the existing failing septic
systems along Tolman Creek, staff supports the request for connection to
the City's sewer system. |
| Fiscal Impact: |
There is no negative fiscal impact to the City. Siskiyou
Village will be required to install the extension of the sewer system to
City standards from the connection at the mobile home park to the City's
sewer system in Benson Way. Siskiyou Village will also be required to pay
the initial Wastewater SDCs and pay for monthly sewer service. There may
be some off setting SDC credits for the extension of the main line to the
mobile home park. Any possible credit for the SDCs would need to be further
reviewed and discussed with the applicant. |
| Background: |
In an "application" letter dated February 2, 2002
(attached), Mr. Bruce Davis is requesting sewer service on behalf of Siskiyou
Village, a mobile home park which is located outside the City limits, but
within the City's Urban Growth Boundary. Siskiyou Village is located at the
corner of Siskiyou and Crowson at 2799 Siskiyou Boulevard, 39 1E 14D TL700.
Siskiyou Village supports 42 mobile home /RV spaces, 7 RV pull-though spaces,
and one fixed studio apartment. All of the units within the mobile home park
are connected to one of two failing septic systems. Siskiyou Village is on
a 10 acre parcel of property just outside City limits, but within the City's
Urban Growth Boundary. The property is within the Tolman Creek drainage basin,
which ultimately drains to Bear Creek.
The applicant has meet the code requirements (see below) with the
exception that the City's main is in Benson Way approximately 860 feet from
the on site system at the mobile home park. The applicant will have to bore
under the railroad tracks, acquire an easement from the adjacent property
owner and construct the new sewer line extension to City standards (minimum
8-inch line) from the railroad tracks to Benson Way. The City will require
that the sewer line from the tracks to Benson be dedicated to the City. That
portion of the line is approximately 750 feet. Once constructed, the City's
system will be within 300 feet of the property line. Siskiyou Village will
be responsible for extending the lateral by boring under the railroad tracks
to extend the sewer service lateral to the mobile home park (approximately
115 feet to the property and another 200 feet to the mobile home park's
collection system). This portion of the line will remain private.
Mr. Davis has been informed of the requirements of Siskiyou Village
and has tentatively agreed to the conditions specified in the ordinance if
authorized the connection. He would like to discuss SDC credits for the public
portion of the sewer line extension from the railroad tracks to Benson Way.
Ashland Municipal Code Section 14.08.030, Connection - Outside
City, Inside Urban Growth Boundary (Amended ORD 2767; October 3, 1995)
An occupied dwelling or building located outside the City of Ashland
and inside the urban growth boundary may be connected to the sewer system
when such connection is determined by the Ashland City Council to be in the
best interest of the City of Ashland and to not be detrimental to the City's
sewage facilities. Such connection shall be made only upon the following
conditions:

The applicant for sewer service pays the sewer connection fee and
the systems development charges established by City Council. The applicant
has been advised of the estimated costs for this connection. For 50 units
that are under 1000 sf each, the cost is approximately $1,128 per unit or
$56,400.

In the event a dwelling or building connected to the sewer system
is substantially replaced for any reason, then the replacement dwelling or
building may continue to be connected to the sewer system of the City as
long as the use of the sewer system will not be increased as determined by
the Director of Public Works. The applicant has been advised of this
requirement.

There is an existing Ashland sewer main or line within 300 feet of
the existing dwelling or building to be connected. The applicant shall be
responsible for the full costs of extending the City of Ashland sewer main
or line to the property for which sewer service is being requested. There
is a sewer main line within approximately 860 feet. The applicant will construct
the sewer connection from Benson Way to the Railroad tracks (approximately
750 feet) and will dedicate this to the City's system. Once that line is
constructed, there will be a City main line within 300 feet of the property.
The applicant has been advised that he will incur the costs for this
connection.

The applicant shall secure, in writing, statements from Jackson County
that the existing sewage system has failed and that the provision of sewer
by the City of Ashland does not conflict with the Jackson County Comprehensive
Plan, support documents, rules or regulations. Jackson County Environmental
Health division has issued a specific written statement that the current
septic systems have failed. The applicant will secure approvals from the
County to ensure that the provision of sewer by the City of Ashland does
not conflict with the Jackson County Comprehensive Plan.

The applicant furnish to the City a consent to annexation of the land,
signed by the owners of record and notarized so that it may be recorded by
the City and binding on future owners of the land. The applicant has indicated
that he will sign consent to annexation, but does not wish to annex at this
time.

The applicant shall provide for the payment to the City by the owners,
at the time of annexation, an amount equal to the current assessment for
liabilities and indebtedness previously contracted by a public service district
such as Jackson County Fire District No. 5, multiplied by the number of years
remaining on such indebtedness, so that the land may be withdrawn from such
public service districts in accord with ORS 222.520 and at no present or
future expense to the City. The applicant has been advised of the requirement
to contact Fire District 5.

The owner shall execute a deed restriction preventing the partitioning
or subdivision of the land prior to annexation to the City. The applicant
has indicated that he will sign a deed restriction.

That the land is within the Urban Growth Boundary. Yes, the property
