| Synopsis: |
This resolution establishes the tobacco license fee
for retail vendors selling such products within Ashland. |
| Recommendation: |
Staff recommends approval of the attached
resolution. |
| Fiscal Impact: |
There is no significant revenue or expense impact
since fee calculation is based upon the estimated cost to the city to administer
the program. |
| Background: |
The recommended fee structure was designed to cover
the application processing, license issuance and other record keeping costs
to support the adopted program. The initial fee for all participating vendors
was set for a six month period to cover the cost of implementing the new
program with renewals occurring simultaneously on an annual basis with business
licenses to minimize ongoing costs for the retailer as well as the City.
Any new applicant will be charged the Initial Fee for the first year, or
fraction of a year, bringing the business into the annual cycle for license
renewal.
This approach will align the application and licensing processes for
the 2500 business and 125 liquor licenses issued in the July to September
period each year |

RESOLUTION NO. 2001-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ASHLAND ADOPTING A LICENSE FEE FOR RETAIL SALE
OF TOBACCO PRODUCTS AS PROVIDED IN ASHLAND
MUNICIPAL CODE SECTION 6.42.040
Recitals:
A. The Tobacco Control Chapter of the Ashland Municipal Code (AMC Ch. 6.42)
requires that all retail vendors of tobacco products within the City of Ashland
obtain a license to sell tobacco.
B. This resolution is intended to satisfy the requirements of AMC §
6.42.040 by establishing the fee for such license.
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. The fee for a license to sell tobacco products at retail
in the City of Ashland shall be as follows:
A. Initial License Fee. The initial license fee shall be $40.00. A license
shall be valid from the date of issuance to the following June 30th. The
fee due on the effective date of the Tobacco Control ordinance (December
6, 2001) shall be $40.00 for a license valid until June 30, 2002.
B. Renewal Fee. The fee for the renewal of a valid and existing license shall
be $20.00. Licenses shall be renewable annually for a term of one year,
commencing on the first day of July. An application for renewal of an annual
license shall be submitted to the city at least thirty days prior to its
expiration date and shall be accompanied by the appropriate fee.
Licensees with a suspended or revoked permit shall be required to pay an
initial license fee upon reinstatement of the license.
This resolution was read by title only in accordance with Ashland Municipal
Code §2.04.090 and duly PASSED and ADOPTED this __ day of ________,
