Synopsis: Approval of the attached "STREET PLUG ACCESS AGREEMENT" would grant the owner of the property at 345 Clinton Street (391E4CA Taxlot 110) access the one-foot wide street plug across the north end of Sylvia Street.
Recommendation: None.
Fiscal Impact: It is recommended that the Council adopt a motion to sign the attached easement form granting access rights over the street plug at the north end of Sylvia Street.
Background: In the early 1980s the Sleepy Hollow Subdivision was developed off of Oak Street. The subdivision created a northerly extension of Sylvia Street, which was intended to provide access to a future subdivision which was proposed on the property now owned by Paul Mace and Kathleen Kahle. A street plug or one foot wide reserve strip was placed across the end of the right of way to restrict access into the property except by a deeded extension of the Sylvia Street right of way. The use of street plugs is a common method to ensure that streets are extended according to the City's Transportation Plan. Because of flood issues the subdivision was never developed and the proposed streets were eliminated from the plan. Mace and Kahle now wish to build a second residence with access onto Sylvia Street and have requested this easement to allow access onto that street. Prior to construction of the residence, the applicant's will need to obtain all necessary land use approvals and building permits.

STREET PLUG ACCESS AGREEMENT

AGREEMENT made this __ day of , between the above-named

Grantor and Grantees. ,

Grantor grants to Grantees a nonexclusive easement across Grantor's land described as follows:

1.00 foot wide strip of land reserved as a "street plug" at the northerly /   terminus of Sylvia Street as established on the plat of the Sleepy Hollow   Subdivision in the City of Ashland, Jackson County Oregon, now of record.

1. Purpose, Scope of Use. This easement shall be for ingress and egress and utility installation and maintenance purposes for the Grantees and Grantees' agent~ and assigns to Grantee's property which adjoins the property described above.

2. Term. This easement shall expire when Grantor's land becomes a public street.

3. Miaintenance. Any road constructed upon the easement shall be maintained by Grantees.

4. Pdor Encumbrances. This easement is granted subject to all prior easemEnts or encumbrances of record.
