Title: First Reading of an Ordinance Adding Section 11.24.020.H to the Ashland Municipal Code to Prohibit Trucks and Buses from Idling while Parked

Synopsis: Council directed staff to develop an ordinance prohibiting bus idling in Ashland. The attached ordinance revisions recommend prohibiting trucks or buses from standing or stopping on a public street or in a public parking area with its engine running, if the engine emits exhaust fumes into the air. Vehicle engines shall be turned off when loading and unloading passengers or merchandise except if:
  • An engine is running for less than three minutes,
  • A vehicle is in the moving traffic lane waiting to move with the normal flow of traffic,
  • An engine is needed to operate equipment used to load or unload merchandise,

The ordinance revisions would not apply to trucks under 12,000 GVW and buses with a carrying capacity of fifteen passengers or less, or emergency vehicles, utility company and maintenance vehicles, the engines of which must run to perform needed work.

Recommendation: It is recommended that the Council adopt a motion to move to second reading an ordinance adding section 11.24.020.H to the Ashland Municipal Code to prohibit trucks and buses from idling while parked.
Fiscal Impact: Adoption of the recommendation has no direct fiscal impact with the exception of enforcing the ordinance requirements and potentially collecting fines if the ordinance is not followed.
Background: Council goals requested that this item be brought to the Council for review and adoption.

ORDINANCE NO.

AN ORDINANCE ADDING SECTION 11.24.0:20.H TO THE
ASHLAND MUNIClPAL CODE TO PROHIBIT TRUCKS
AND BUSES FROM IDLING WHILE PARKED

THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:

Annotated to show deletions and additions to the code sections being modified.

Deletions are lined-through and additions are underlined.

SECTION 1. The following section is added to the Ashland Municipal Code as section

11.24.020.H:

SECTION 11.24.020 Prohibited parking. In addition to the provisions motor vehicle laws of Oregon prohibiting parking, no person shall park:

A.  A vehicle upon a bridge, viaduct, or other elevated structure used as a street or within a street tunnel in this City, unless larked or indicated otherwise;

B.  A vehicle in an alley except to load and unload person or materials not to exceed twenty (20) consecutive minute s in any two (2) hour period;

C.  A vehicle upon a street for the principal purpose of:

3. Displaying the vehicle for sale;

4. Washing, greasing, or repairing the vehicle exce )t repairs necessitated by an emergency;

5. Selling merchandise from the vehicle except in established marked place or when so authorizec or licensed

under the ordinance of this City;

6. Storage, or as junkage or dead storage for more than seventy-two (72) hours.

D.  A vehicle upon any parkway except where specifically aluthorized;

E.  A vehicle upon private property without the consent of t he owner or person in charge of the private property; '

F.  A vehicle within any area marked off by yellow paint upon the street or upon the curb, except where specifically authorized by a traffic sign. (Ord. 1557 S13, 1968)

G.  A vehicle or any part thereof upon a sidewalk or bicycle path. (Ord.1971 S1, 1978)

H.  Stand or stop a truck or bus on a public street or in a parking area with its engine running, if such engine emits exhaust into the air. Vehicle engines shall be turned off when loading and unloading passengers or merchandise. This subsectior apply to:

  1. An engine running for less than three minutes,
  2. A vehicle in the movinq traffic lane waiting to move with the normal flow of traffic,
  3. An engine needed to operate equipment used to load or unload merchandise,
  4. Trucks under 12,000 GVW and buses with a carrying capacity of fifteen passengers or less, or
  5. Emerqency vehicles, utility company and maintenance vehicles, the engines of which must run to perform needed work.
