Proposed RESO - Open Space

[ Council Communication ]   [ Proposed Resolution ]

Council Communication
Title: Approval of Partition Plat and a Resolution Dedicating Property for Open Space Park Purposes Pursuant to Article XIXA, Section 2, of the City Charter (Bryant Family Trust Property Located at 667, 669, and 669 ½ North Main Street).
Dept: Legal Department
Date: April 2, 2002
Submitted By: Paul Nolte
Reviewed By: Greg Scoles, City Administrator

Synopsis: The partition plat divides the property located at 667 North Main Street into two parcels. The resolution dedicates the larger parcel for open space purposes. The property was purchased by the city in March 1999 from the Bryant Family Trust B with open space funds.
Recommendation: Move to authorize the Mayor to sign the partition plat. Move to adopt the resolution to dedicate Parcel No. 1 for open space.
Fiscal Impact: None. The property was purchased in March 1999 with open space funds as authorized by the council and the parks commission. Development costs to date related to the partition plat have been paid by the parks department as will any remaining survey and recording costs. Total costs are estimated to be approximately $3,750.
Background: The council and parks commission approved purchase of this property for open space purposes in 1999. The purchase was made with the intent that approximately 1.5 acres of the total 1.88 acres be developed as a neighborhood park. The city received approval under Planning Action No. 99-137 to divide the parcel on January 11, 2000. At the March 2002 park commission meeting the commission approved the final lot layout to accommodate and preserve all significant features. The final lot configuration consists of Parcel No. 1 (1.55 acres or 67, 518 SF for open space) and Parcel No. 2 (.33 acres or 14,375 SF containing a house). It is anticipated the house property will be sold to reimburse the open space fund. Article XIXA, Section 2, of the city charter requires that land acquired for open space purposes shall be dedicated by the council for such purposes.
