Title: Approval of a Land Partition Plat & Dedication of Open Space Property

Synopsis: In October of 2002 the City of Ashland through its Parks and Recreation Department acquired a one half interest in a 1.86 acre parcel of land off the end of Liberty Street. Kurtz and Walsh Property LLC owns the remaining half interest. The attached partition plat allocates Parcel No. 1 (0.99 ac) to the City and Parcel No. 2 (0.88 ac) to Kurtz/Walsh. The City property to be dedicated as open space.
Recommendation: It is recommended that the City Council adopt a motion to approve the attached land partition survey plat and the attached resolution dedicating Parcel No. 2 as open space.
Fiscal Impact: City Purchase Price $139,750.00

Survey Cost $3,500.00

Background:

In October of 2002 the City of Ashland entered into a memorandum of understanding regarding the division of real property located off Liberty Street (Tax Lot 391E16AC-200) whereby the City Park and Recreation Department and Kurtz/Walsh Property LLC would jointly purchase the property then divide the property into two separate parcels. The City would acquire the larger parcel and would dedicate it as open space. Kurtz/Walsh Properties would acquire the westerly parcel as a future building site.

The land purchase was approved by the Parks Commission and the land division was approved by the Ashland Planning Commission under Planning Action No. 2003-009.

Pedestrian easements and trails been provided from Liberty Street across the City parcel to connect with the irrigation ditch trail system.

The partition plat must be signed by the Mayor prior to recording. Once the plat is recorded separate deeds will be prepared to finalize the ownership of the tow newly created parcels.
